Poland Completes Draft Amendment to Renewable Energy Sources Act for Net-Billing Prosumers
The Ministry of Climate and Environment has finalized the draft amendment to the Renewable Energy Sources (RES) Act, which aims to improve the profitability of investments for prosumers covered by net-billing. Introduced in the second quarter of 2022, net billing led to a decline in home photovoltaic installations due to uncertainty regarding compensation for surplus energy sent to the grid. The situation was further complicated in July 2024, with the transition from average monthly wholesale energy price (RCEm) settlements to hourly-based RCE pricing.
To address these challenges, the Ministry has proposed new regulations to enhance the attractiveness of net-billing. Key changes include allowing current net-billing prosumers to return to monthly RCEm price settlements and offering a slightly higher refund (30%) for the prosumer deposit unused for 12 months. Additionally, the value of the prosumer deposit in net-billing will be increased by 23%, aligning it with the VAT rate for energy purchased from the grid.
Climate Minister Paulina Hennig-Kloska confirmed that the draft will be presented to the Council of Ministers this month, and following government approval, it will be sent to the Sejm for further deliberation. The Ministry has assured that there will be no retroactive correction for those returning to monthly RCEm settlements.
